Terms and Conditions

§ 1 Scope

These Terms and Conditions apply to all contracts concluded between YOUspan (not yet founded) (hereinafter "Provider") and the customer via the website youspan.de.

§ 2 Contracting Party

§ 3 Service Description

The provider offers a digital health platform for fitness studios and their members. The platform includes:

• Blood analysis services in cooperation with certified laboratories
• Fitness and health tracking
• Personalized health recommendations
• Dashboard and analysis functions

§ 4 Contract Conclusion

The presentation of products on the website does not constitute a legally binding offer, but an invitation to order. Signing up for the waitlist or submitting an inquiry does not constitute a contract. The contract is only concluded through the express confirmation of the provider.

§ 5 Prices and Payment

All prices quoted include statutory VAT. Payment terms are regulated in the respective offer or contract. (Further details will be provided after incorporation)

§ 6 Right of Withdrawal (for B2C) (Company not yet founded)

§ 7 Liability

The provider is fully liable for intent and gross negligence. In the case of simple negligence, the provider is only liable for breach of essential contractual obligations and limited in amount to the foreseeable, typical damage.

§ 8 Data Protection

The processing of personal data is carried out in accordance with our privacy policy. Health data is treated as special categories of personal data in accordance with Art. 9 GDPR and is only processed with express consent.

§ 9 Confidentiality

Both parties undertake to keep confidential all confidential information obtained in the course of the contractual relationship and not to disclose it to third parties.

§ 10 Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should individual provisions of these Terms and Conditions be invalid, this shall not affect the validity of the remaining provisions.
